Jennie, I agree its a very sticky matter because of the liabilaties, if its illegal you are hampered by the criminality of it not the creativity involved, if you are the home or property owner you reserve a right to protest or profit from it. An unusual case is of course Bansky, I was in Brighton a few years back and saw one of his public works on the outside of a pub wall and it was shielded with plexiglass, the owner told me he had hoped to carve it out and sell it some day, consequently I had seen an article suggesting that all public works by Bansky be protected, go figure! Now there is a second matter to this that many of us writers and enthusiasts are complicit of and that is us taking work off the street ourselves, stickers, posters, sculptures etc, I myself have snagged a few stickers as keepsakes. Some have whole sticker collections, someone like my dear friend Marty Cooper collects stickers and published a book on the phenomena, thankfully she is regarded documentor in our culture but what if she weren't? One could not refute her actions given that it is illegal to put stickers up.

Once we enter the public space its a matter of public consumption and there are ways to protect oneself, one of which has come to light is that once it is published online there is a precedence set of public record so if you see something of yours and the image was lifted from the site therein lies the copyright infringement. I would also add that registering a brand name or your tag for copyright may help especially if you do legal walls. In the US we have VLA Volunteer Lawyers for the ARTS which is a great resource in these matters.

This article plays into what I argued in my dissertation 4 years ago...
Due to its increased commercialisation, value, and public access (not to mention its often illegal execution, leaving the artist totally incapable of claiming rights to it)... In regards to copyright, graffiti & street art is in a league of its own- a total gray area actually- that now requires bespoke laws and ethical codes of conduct [around copyright].
Of course, it opens up the whole debate about public space and ownership: the artist owns the paint/the landlord owns the bricks, but it might be time for graffiti/street artists to unite on this one. For starters, 'public space' is actually owned by tax payers, yet city officials usually take matters into their own hands without asking the public. Second, we have people in London physically sawing out pieces of 'Banksy walls' and selling the piece at high end auction houses as if its standard practice.. in response, the artist set up their own authentication agency. Go to any London market and you'll see all the big artists on t-shirts, coasters and the like... there was even a gallery which only sold thieved Flickr photos of street art printed onto canvas! These artists don't see a penny of this merchandise, and are rarely credited... and most of the time they are between a rock and a hard place if they paint illegally- how could they attempt to prosecute for copyright without owning up to committing a crime? Companies like the rug maker deliberately take advantage of this and the fact that most artists couldn't afford to prosecute even if they did own up to it. Time to fight for your rights.

Brilliant article. Some very good points you make here. The internet has definitely become a breeding ground for thievery and dimished artistic integrity in many cases. The lack of respect for certain people in regards to re-appropriating other peoples works or copying styles without credit is astounding and on the rise. The internet is a great place to share one's work but you are certainly right in suggesting that people search their names and keep up to date on the scene to be able to catch the thieves in action. Love this site. Keep up the good work!

GRAFFUTURISM:

it's not everyday you hear the term MASTER MAPPER; and if ZULU GREEN . . . is who I imagine him to be; then it's almost never; you get a TWO for ONE special; at the dope spot. wow . . . chicken skin effects.

for those uniformed; MASTER MAPPER was a title; a designation; given to me . . . by RAMMELLZEE the IKONOCLAST PANZERISM architect and undisputed DEAN of DYNAMICS in the NEW YORK CITY SUBWAY SCHOOL of ART. even then; especially then; in NINETEENEIGHTY . . . it was difficult to comprehend what RAMM was talking about; ARMING LETTERS, COUNTERSTRIKING and if I'm not mistaken; creating WEAPONS of DESTRUCTION? he hadn't calculated the MASS; but the theory was beyond poetic; he was a PROPHET.

he is missed and loved on the daily.
there but for the GRACE of GOD go I; and no matter who we are; or how we do; we are all part of this experiment.
